By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.
2. Intellectual Property and Use License
All Intellectual Property Rights in the Course Materials, Online Courses, One on One Coaching and the speeches made by trainers at the Taught Courses are, and remain, the intellectual property of The Leadership Effect or its licensors, whether adapted, written for or customised for the Client or not. Permission is granted to temporarily download one copy of the materials (information or software) on The Leadership Effect’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you not authorised to;
- copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission
- record on video or audio tape, relay by videophone or other means the Online Course or Taught Course given
- use the Course Materials in the provision of any other course or training whether given by us or any third party trainer;
- remove any copyright or other notice of The Leadership Effect on the Course Materials;
- modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by The Leadership Effect at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
In consideration of the Fees paid by you, we grant to you a limited, non-transferable, non-exclusive licence to use the Course Materials and the software in respect of the Online Course for the sole purpose of completing the Online Course and / or attending the Taught Course.
- Warranty
The materials on The Leadership Effect’ web site are provided “as is”. The Leadership Effect makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, The Leadership Effect does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
- Disclaimer
In no event shall The Leadership Effect or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on The Leadership Effect’ Internet site, even if The Leadership Effect or a The Leadership Effect authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

- Technical Support and Access
If you are unable to access an Online Course, The Leadership Effect will use reasonable endeavours to provide a solution where The Leadership Effect has direct control over the system, software or settings involved. If the issue lies with your hardware, systems, software or settings thereof, The Leadership Effect may, in its discretion, provide assistance to you to help you resolve the issue but we cannot guarantee that any assistance provided will resolve your issue.
You accept and acknowledge that periods of downtime may be required in respect of the information technology infrastructure connected to the Website and that technical assistance may not be available during such periods of downtime. Further you accept that you will not have a claim for breach of contract or otherwise in respect of such period of unavailability.
The Leadership Effect will use reasonable endeavours to make the Online Course available but cannot guarantee uninterrupted, timely or error free availability or that defects will be corrected. The Leadership Effect reserves the right to suspend access to the Website for the purpose of scheduled or emergency maintenance, repairs or upgrades to improve the performance or functionality of the Website.
You also accept and acknowledge that The Leadership Effect cannot be held responsible for any delay or disruptions to your access to the Online Course as a result of such suspension or any of the following:
(a) the operation of the internet and the world wide web, including but not limited to viruses;
(b) any firewall restrictions that have been placed on your network or the computer you are using to access the Online Course;
(c) failures of telecommunications links and equipment; or
(d) updated browser issues.
- Links
The Leadership Effect has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by The Leadership Effect of the site. Use of any such linked web site is at the user’s own risk.

The Leadership Effect may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
- Governing Law
Any claim relating to The Leadership Effect’s web site shall be governed by the laws of the State of Australia without regard to its conflict of law provisions.
10. Entire Agreement
These terms and conditions, together with the Privacy Policy and Course, Program and Coaching Specific Terms and Conditions are the entire agreement between the parties and supersede any prior agreements and arrangements, whether written or oral. You confirm that you have not relied on any representations in entering into these and any other terms and conditions with us. Nothing in this clause or terms and conditions shall limit liability for any fraudulent misrepresentation.
11. Force Majeure
The Leadership Effect shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the trainer’s family, illness of the trainer, Government edict or regulation.
12. Assignment
We may assign, transfer, sub-contract any of our rights or obligations to any third party at our discretion.
13. Data Protection
The nature of the Services provided by us means that we will obtain, use and disclose (together "Use") certain information about you ("Data"). This statement sets out the principles governing our Use of Data. By purchasing the Services you agree to this Use.
When you register with us you will need to provide certain Data such as your contact details and demographic information. We will store this Data and use it to contact you, provide you with details of the Services you have purchased and otherwise as required during the normal provision of the course.
We may also use the above Data, and similar Data you provide us in response to surveys, to aggregate user profiles and, unless you click on the relevant button on the Registration Form, provide you with communications. We will not pass any personal data onto anyone outside of The Leadership Effect,
To enable us to monitor and improve our Services, we gather certain aggregated information about you, including details of your operating system, browser version, domain name and IP address, the URL you came from and go to and the parts of the Website you visit.
We use information such as your User ID, session identifiers and password to enable us to identify whether you are using our services, assist with the provision of services and to ensure that you have access to relevant products. We will only read cookies from your cookie file placed there through your web browser's interaction with the Website.
Our products may link to third party websites and we are not responsible for their data policies or procedures or their content.
The Leadership Effect endeavour to take all reasonable steps to protect your personal Data including the use of encryption technology, but cannot guarantee the security of any Data you disclose. You accept the inherent security implications of being and transacting on-line over the internet and will not hold us responsible for any breach of security.
The Leadership Effect may supplement the information that you provide with information we receive from third parties, such as exam registration bodies or your employer.

Cancellation & Refund Policies
All requests for cancellation or refund must be submitted via email to hello@leadershipeffectfect.com.au
Sessions and Appointments
We value your time and ours. We have a number of rules around appointment cancellation.
We will always take into account your individual circumstances before applying any cancellation fees.
- Less than 48 hours notice of cancellation will incur 50% fee. Refunds for the remaining 50% will be processed within 7 days if the fee has been paid upfront.
- Less than 24 hours notice will incur the full fee. Any emergencies beyond your control will be credited for a future session(s).
Courses and Programs
- No refunds apply to courses with instant access, as we deem this a digital product.
- Requests for course or program cancellation are processed within 48 hours.
- Cancellation of a subscription product will remove your access to all course material immediately.
Digital Products
- No refunds apply to digital products which include images, audio files, video files, document downloads, PDF downloads.
Leadership Program Cancellations
- Cancellation must be made at least 30 days prior to the event to qualify for a refund or credit.
- Less than 30 days notice of cancellation is eligible for a 50% refund (we will refund the 50% within 7 days if the fee has been paid upfront, if you have not yet paid 50% of the total due fees, you must pay this out to cancel.
- Less than 7 days notice of cancellation is not eligible for a refund.
Physical Products
- You may cancel your order within 1 hour of purchase for a full refund.
No refunds apply when:
- A product has already been shipped, received in good condition, and is the product that was ordered, no refunds will be given for the order.
- You cancel your order after your item has been shipped.
- You have purchased a digital product.
- The refund period has lapsed on your order.
- You miss your scheduled appointment.
